This Privacy Policy sets out how and for what purpose we collect, process and store your personal data and how we protect it. Abiset s.r.o. (hereinafter the "controller") undertakes to process personal data provided by customers or website visitors in accordance with Act No. 428/2002 Coll. and Act No. 18/2018 Coll. on the protection of personal data, as amended, and in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council (hereinafter "GDPR").
Privacy policy in accordance with GDPR
Basic information
The purpose of this document is to give you open information about what personal data we obtain, how we handle it, from what sources we obtain it, for what purposes we use it, to whom we may provide it, how long we keep it and what your individual data protection rights are.
Customers' personal data is collected, processed and/or used only if the customer has allowed it by placing a binding order, or if the relevant legal regulations require or permit it. The customer may withdraw their consent at any time. A binding order is an order delivered physically and signed by the customer, an order sent by email or an order completed on the controller's website. A telephone or personal order, or an order placed in any other way (for example in the chat on the website), is also considered binding if it is subsequently confirmed by proper payment of an invoice or proforma invoice.
The data the customer enters when ordering is transmitted in encrypted form and stored electronically (encryption protocol used: TLS 1.2, key: RSA 2048 bit, user data encryption: AES-256 (256 bit)). The controller's employees are obliged to keep personal data confidential and may process it only for the purpose and in the manner defined in this privacy policy.
The data left by the customer will not be passed on to third parties without their explicit consent, which can be withdrawn at any time. This does not apply to the transfer of data to third parties entrusted with the technical processing of the order or the delivery of goods or services, if this is necessary for the delivery of the goods or service. These third parties may use the customer's personal data only for the purpose of delivering the goods or service.
Customers and visitors of the controller's website are informed of the rules for processing personal data when ordering and whenever they provide personal data to the controller. This Privacy Policy and the consent to the processing of personal data are publicly available on the controller's website https://www.ikelp.cz.
The controller provides its products and services exclusively to persons who are of legal age, have full legal capacity and are at least 18 years old. We also process personal data only of persons of legal age with full legal capacity. If you do not meet these conditions and the controller discovers this, your personal data and your profile on the controller's website will be deleted. The controller will also stop providing its products and services to persons who do not meet the above criteria.
If you have not been able to resolve your questions or objections regarding personal data protection satisfactorily, you have the right to contact the Office for Personal Data Protection of the Czech Republic, Hraniční 12, 820 07 Bratislava 7, https://www.dataprotection.gov.sk.
Do I have to provide personal data to the controller?
Providing personal data, like concluding a contract or another business relationship with the controller, is voluntary. However, some data is necessary to fulfil legal obligations (for example keeping accounts) or to provide the service, and without some data the controller cannot provide the requested service or deliver the requested goods. Personal data that the provider would collect and process for any purpose other than those stated above is always subject to the separate consent of the customer or website visitor. If the customer or website visitor does not give us such consent, we will not collect and process personal data for any purpose other than those stated above.
What personal data of the customer or website visitor does the controller process?
In order to provide the customer with the requested goods or services, the controller obtains and processes the following personal data:
- customer identification data (business name, company ID (IČO), tax ID (DIČ), VAT ID (IČ DPH), registered office address, business location address(es), general company contact details)
- contact details of the customer or of persons authorised by the customer (name, email, telephone)
- data on which of our products or services we provide to you and how you use them
- records of mutual written communication
To improve the controller's services and websites, the controller obtains and processes personal data through the following services and technologies:
- Cookies
- Google Analytics
- Fathom Analytics
- Lucky Orange
- Zendesk
- OneSignal
- Google API Services
Detailed information about these services and technologies is given later in this document.
For what purposes does the controller use and process personal data?
The controller processes personal data without clients' consent to fulfil its legal obligations, for the purposes of contract negotiations and the provision of the provider's services and products, to protect its rights and legally protected interests, to ensure operational security and prevent fraud, and to analyse and evaluate possible risks.
With the client's consent, we process data for marketing purposes beyond legitimate interest, i.e. including profiling and offering the controller's products and services.
How does the controller ensure the protection of personal data?
Personal data is under constant physical, electronic and procedural control, and the controller has modern control, technical and security mechanisms that ensure the maximum possible protection of processed data against unauthorised access or transfer, loss or destruction, and any other possible misuse. All persons who come into contact with customers' personal data in the course of their work or contractual duties are bound by a legal or contractual duty of confidentiality.
From what sources does the controller obtain personal data?
We process data that you provided to us in connection with negotiating a contract and the provision of the controller's services or products, or that you provided in the same connection to our business and service partners. We also process data you provided when registering on the website or setting up services or products. We use personal data obtained in this way exclusively to deliver the requested services and products and for the related accounting and legally required records. Based on your separate consent or the permission settings of the applications you use, we may also process other data, for example from web browsers, satisfaction surveys and user testing.
To whom does the controller provide or transfer personal data?
The controller transfers personal data to state authorities if this obligation is laid down by law (e.g. an audit of accounting records) and, where necessary, to protect the controller's rights (e.g. when recovering a debt through the courts). The controller may entrust a third party, a so-called processor, with processing data. Processing is possible only on the basis of a contract that obliges the processor to the same level of data protection as the controller provides. Data may also be transferred to suppliers providing services for the controller, such as software installation and training at the customer's premises. The exact list of processors and suppliers to whom personal data is transferred can be found on the controller's website. With the customer's consent or on their instruction, personal data may also be provided to other persons.
What are your rights in relation to the processing and transfer of personal data?
In accordance with applicable legislation, you can exercise your rights as a data subject. You have the right to access the data we process about you, the right to portability of selected data and the right to have data corrected. You can ask for personal data to be erased, unless it still needs to be processed to fulfil legal obligations or is needed so that we can continue to provide the services you ordered.
What are your options for restricting the processing and transfer of personal data?
Where the controller processes personal data on the basis of your consent, you can withdraw this consent at any time. Where your data is processed on the basis of legitimate interest, you can object to such processing. We will evaluate every such objection and inform you of the result. We will always comply with an objection to processing data for marketing purposes.
Where can you turn for further information and where can you raise objections regarding the processing of personal data?
Customers and visitors of the controller's website can contact us at any time by phone at +421 34 239 95 41 or by email at podpora(at)ikelp.cz, where they will receive answers to all questions concerning personal data.
Cookie policy
Use of cookies
The individual websites of the company's portfolio use cookies that help us provide better services. By using the websites, you give the website operator your consent to the use of cookies in accordance with your browser settings. If you visit our websites and your browser allows cookies, we consider this to be acceptance of our cookie policy. Instructions for changing cookie settings can be found in the help section of each browser.
What are cookies?
Cookies are small text files that may be sent to your browser when you visit websites and stored on your device (a computer or another device with internet access, such as a smartphone or tablet). Cookies are stored in your browser's file folder. Cookies usually contain the name of the website they come from, their validity and a value. On your next visit to the website, the browser loads the cookies again and sends this information back to the website that originally created the cookie. The cookies we use do not harm your computer.
Why do we use cookies?
We use cookies to build our services optimally and keep improving them, to adapt them to your interests and needs, and to improve their structure and content. The websites may use temporary and persistent cookies. Temporary cookies are kept on your device until you leave the website. Persistent cookies remain on your device until they expire or are deleted manually. How long we keep the information depends on the type of cookie.
We use several types of cookies on our websites.
- Essential cookies
These cookies form the basis for running our websites and enable basic functions such as secure areas or online payments. Essential cookies include, for example, remembering your login, allowing access to secure areas without signing in again, pre-filling forms and the like. Without these cookies we cannot provide the services that form the basis of our websites. If you disable these cookies, we cannot guarantee that the websites will work correctly.
- Performance cookies
With performance cookies we collect statistical information about how you use our websites. This technical information tells us, for example, which parts of the website you clicked on, which page you visited last and so on. We use these cookies to analyse and improve the content, performance and design of our websites. If you disable these cookies, we cannot guarantee that our websites will work correctly.
- Functional cookies
Functional cookies are not essential, but they help us improve the functionality of our websites. For example, they remember settings chosen during a previous visit, such as content layout or location, so that you don't have to set them again. With these cookies we find out whether you have already been offered a certain service, or we provide information from your current area if you agree to share such information. Although the use of these cookies depends entirely on your settings, disabling them could mean losing some services we could provide to you.
- Advertising cookies
We may use advertising cookies on our websites to show content and advertisements tailored to your interests. These cookies may collect information about your browsing habits on our websites. They may also be used to recognise your repeat visit to one of the websites in our network. In this way we can provide content and advertisements on our websites that are more relevant to you, target direct marketing communication more effectively, limit the number of times an ad is shown and measure the effectiveness of advertising campaigns.
- Third-party cookies
The websites contain links to and embedded content from other websites. Cookies may therefore be created while using our websites that are not controlled by our company. This happens, for example, if the page you are viewing uses an analytics or marketing automation tool from a third party (for example Google tools) or shows content from a third-party website, e.g. YouTube or Facebook. As a result, cookies from these third-party services are accepted. Our company has no control over the storage of or access to these cookies. To find out how these third parties use cookies, read the privacy policies and cookie policies of these services.
How can you change cookie settings?
Under Section 15 of the Electronic Media Act, as a website visitor you can refuse the storage of your anonymised data, so your visit will not be recorded in the future. You can set the cookies used on the websites in your web browser. Most web browsers are set to accept cookies automatically by default. You can change this setting by blocking cookies or by being notified when cookies are about to be sent to your browser or device. Instructions for changing cookie settings can be found in the help section of each browser. If you use different devices to access the websites (e.g. a computer, smartphone, tablet), we recommend adjusting each browser on each device to your cookie preferences. We will respect it if you change the default cookie settings. However, disabling some cookies may affect the functionality of our websites.
For Google services you can also use the opt-out page.
Google Analytics
On our website we collect and store data using a tracking tool for marketing and optimisation purposes. For this our website uses Google Analytics, a service of Google Inc. ("Google"). Google Analytics uses so-called "cookies", text files stored on your computer that allow usage to be analysed. Information about your use of the website generated by cookies is usually transferred by Google to a Google server in the USA and stored there. However, within member states of the European Union or other contracting states of the Agreement on the European Economic Area, Google shortens (anonymises) your IP address. This shortens the IP addresses obtained via Google Analytics. This measure is intended to prevent Google from linking IP addresses to personal data. Only in exceptional cases is the full IP address transferred to a Google server in the USA and shortened there. On behalf of the operator of this website, Google will use this information to evaluate the use of the website, to compile reports on website activity and to provide the operator with other services related to the use of the website and the internet. The IP address transmitted by your browser within Google Analytics is not linked with other Google data.
Without your explicit consent, we will not use tracking tools to collect your personal data without your knowledge, pass this data on to third parties and marketing platforms, or link this data with your personal details (name, address, etc.).
Fathom Analytics policy
Use of a website traffic analysis service
We use Fathom Analytics to understand the traffic on our websites in the way that is most privacy-friendly for website visitors. This allows us to keep improving our websites.
How does Fathom Analytics work?
We want as little personal data as possible to be processed when you use our websites. That is why we chose Fathom Analytics to analyse traffic on our websites. It does not use cookies and complies with GDPR, ePrivacy (including PECR), COPPA and CCPA. With this privacy-friendly website analytics service, your IP address is processed only for a brief moment and we (the website operator) cannot identify you in any way. Under the CCPA, your personal data is "de-identified". You can read more about the service on the Fathom Analytics website.
Is explicit consent to the processing of personal data required?
No, it is not, because Fathom Analytics does not store any personal data over time. In addition, within the meaning of GDPR Article 6(1)(f), it is our legitimate interest to keep improving our websites and business.
Lucky Orange - Web Analytics Service policy
Use of a website analytics service
The individual websites of the controller's portfolio use the Lucky Orange service, which helps us provide better services by improving the quality and usability of the websites. By using the websites, you give our company consent to the use of the Lucky Orange service. You can withdraw this consent as described below.
What is Lucky Orange?
This service may record mouse clicks, mouse movements and scrolling activity on the page. It may also record keystrokes when data is entered on the page. Lucky Orange does not create any records or track activity on any website that does not use the Lucky Orange system. More information about the privacy policy of this service can be found at https://www.luckyorange.com/privacy.php.
Why do we use Lucky Orange?
We use Lucky Orange and the records it creates exclusively to improve the quality of our websites. This service helps us identify the parts of the pages that need adjusting to make them clearer and easier to use. The records are anonymous and are deleted on an ongoing basis after processing. We mostly use Lucky Orange to a limited extent, only temporarily on new pages to test their practical usability.
How can you change Lucky Orange settings?
If you want to view or manage the data Lucky Orange has recorded about your visit to our websites, go to https://privacy.luckyorange.com/. Clicking the "Do not track me" button turns off the recording of your visits by Lucky Orange.
OneSignal - Push notification system policy
Use of a notification service
Some websites of the controller's portfolio use the OneSignal service, which helps us send messages (push notifications) to visitors who subscribe to such messages. By subscribing, the visitor consents to the use of this functionality. You can withdraw this consent as described below.
What is OneSignal?
This service works as a notification channel through which the provider sends messages to its subscribers according to their settings for which messages they want to receive. The service itself meets GDPR requirements: https://onesignal.com/privacy. Sending messages through this service is anonymous and we, as the controller, do not know who the subscribers of a given message are.
Why do we use OneSignal?
We use OneSignal exclusively to inform subscribers about news, articles and other information on this website that they have subscribed to.
How can you change OneSignal settings?
If you have subscribed to messages on our website and want to change or cancel this setting, block push notifications from our website in your browser settings. Another option is to choose, when such a notification is shown, that you no longer want to receive these notifications. Also, if you stop visiting our website, you will automatically be unsubscribed from these notifications.
Zendesk policy - online chat on our websites
Use of the Zendesk service
The Zendesk service provides communication, an online chat, between a visitor of the controller's website and an operator. The website visitor does not have to use this service; its use is voluntary.
What is Zendesk?
Zendesk shows a communication window to the website visitor, where they can enter their questions and communicate with an operator, or leave a message for the operator to handle later. The service provides operators with an online application where they can communicate with individual website visitors and answer their questions. If a website visitor leaves a message for the operator, it is delivered by email via Zendesk. Detailed information on security and personal data protection can be found on the website of the provider of this service: https://www.zendesk.com/company/customers-partners/privacy-policy/.
Why do we use Zendesk?
We strive to create clear website content so that visitors always find what they need, such as guides or information about our products. Even so, a visitor may have additional questions. For this they can use the online chat directly on the controller's website. The aim of the online chat is not to collect personal data; communication with the operator is anonymous. However, this does not rule out that a website visitor voluntarily leaves their contact details so that the operator or another employee of the controller can contact them with an answer to their question.
What personal data do we collect and process, how and for what purpose?
The operator whose task is to answer website visitors' questions or messages has access to the following information: the website visitor's country or location, the type of device used to browse the website and the address of the page the visitor is currently viewing. This information is used solely so that the operator can give the visitor the best possible answer, in the right language and on the topic or products they are interested in. The operator has this information only while the visitor is browsing the controller's website. After the visit ends, this information is not archived. The website visitor can leave a message for the operator, which will be delivered by secure email. If the website visitor includes their personal data in the message (most often email, phone and name), they consent to the operator using it to contact the visitor and answer their question. After it has been dealt with, the message will be deleted together with the personal data it contained. The personal data provided will not be used for any purpose other than the one stated above.
Google API Service policy - sign-in
Use of the website sign-in service
To sign in, the customer can use Google sign-in, as on other websites. The customer therefore does not have to remember separate login details for this website; when signing in, they are redirected to Google's website, where they sign in to their profile.
What is Google API Service?
We use this service only to sign the user in to their profile on this website. From the service we request only the necessary data: the public email and publicly marked details, i.e. first name, surname and picture, for identification and correct matching of the profile.
How can you change Google API Service settings?
After signing in, you can see the connection with your Google account in your profile. There you can remove this connection, and with it the data we obtained through it. After that it will no longer be possible to sign in to this profile easily with Google API Service sign-in. You can set which data you share publicly in your account profile with Google.
Consent to the processing of personal data
Through the web application, in accordance with Section 7 of Act No. 428/2002 Coll. on the protection of personal data, I hereby give consent to the processing of personal data to the extent I have provided, in particular my first name, surname, email address and telephone number (hereinafter "Personal data"), to Abiset s.r.o., company ID: 36289141, registered office Bernolákova 1A, Malacky, postcode 90101, as the controller of Personal data (hereinafter the "Controller").
The purpose of processing Personal data is to provide or deliver the goods and services I have ordered, and further to provide important information about the products and services of the Controller and other entities, including sending offers of goods and services on request, also by electronic means (in particular by telephone, email, SMS and MMS). Important information about products and services includes in particular:
- notification of the release of a new version of the application or service in use
- notification of features related to changes in legislation
- notices of important application or service settings and guides on the controller's website that relate to changes in legislation or have a significant impact on the use of the controller's products and services
- invoicing and accounting records
- and the performance of other actions the Controller must carry out so that the user can properly use the purchased products or services
I also consent to the Controller transferring personal data to other processors who carry out further processing of personal data and subcontracted services for it, but only within the scope of the principles and conditions stated above. I also declare that I am of legal age, have full legal capacity and am at least 18 years old.
I give consent to the processing of Personal data voluntarily, until this consent is withdrawn.
Notice: You can withdraw this consent at any time after signing in at https://www.ikelp.com/sk/dashboard or by sending a request to podpora(at)ikelp.cz. Your personal data will be deleted without delay, except where deleting it would make it impossible to properly provide the ordered services or protect the Controller's rights (for example recovering an outstanding amount).
